I believe it is OK with AdSense TOS, because what they don't like since january 2007 is images that make it look like they are related to the ads (ie. mobile phone images above an adsense leaderboard on a page about mobile phones) or that they draw undue attention to the ads, like arrows pointing to the ads or the worst: a "click here" suggestion... But background images add to your site design and as such don't hurt the advertisers or the users and neither Google. But the best thing is to ask the AdSense team about that.
